advertiser ensure COPPA compliance:<\/a><\/li><li class='ez-toc-page-1'><a class=\"ez-toc-link ez-toc-heading-6\" href=\"https:\/\/www.adpushup.com\/blog\/coppa-compliance-for-websites-frequently-asked-questions\/#In_Closing\" >In Closing&nbsp;<\/a><\/li><li class='ez-toc-page-1'><a class=\"ez-toc-link ez-toc-heading-7\" href=\"https:\/\/www.adpushup.com\/blog\/coppa-compliance-for-websites-frequently-asked-questions\/#FAQs\" >FAQs<\/a><\/li><\/ul><\/nav><\/div>\n<h2 id=\"h-what-is-coppa\"><span class=\"ez-toc-section\" id=\"What_is_COPPA\"><\/span><strong>What is COPPA?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>COPPA stands for <em>\u2018The Children\u2019s Online Privacy Protection Act of 1998.\u2019 <\/em>&nbsp;This act is enforced by the <a href=\"https:\/\/www.ftc.gov\/tips-advice\/business-center\/guidance\/complying-coppa-frequently-asked-questions-0#A.%20General%20Questions\">Federal Trade Commission<\/a> (FTC) that stipulates what online service providers, website operators, and marketers should do to protect minor\u2019s privacy and safety on the web.&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Though the act is 20 years old, the need for COPPA compliance has increased over the past few years because of heightened cases of online child abuse and privacy violations.&nbsp;<\/p>\n\n\n\n<p>For example, YouTube received a whopping fine of <a href=\"https:\/\/www.cnet.com\/tech\/mobile\/youtube-170m-fine-kids-video-policy-changes-google-settle-ftc-investigation\/\">$170 million<\/a> in September 2019 for COPPA violations. <\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Like YouTube, Google has also faced pressure from privacy regulators. In March 2020, the search engine was <a href=\"https:\/\/www.cnet.com\/news\/google-fined-1-7bn-for-abusive-online-ad-practices-in-the-eu\/\">fined $1.7 billion<\/a> by the European Commission for collecting personal information from minors.&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>The primary goal of COPPA is to ensure parents have control over the information that websites are collecting from their children. The rule protects children who are under 13, and applies to operators of online services and commercial websites that collect, disclose, or use visitor data to serve targeted advertising.&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>The term \u2018<em>online services<\/em>\u2019 covers any service available over the web that allows users to connect to a wide-area network. For example, services that allow users to engage in <a href=\"https:\/\/www.adpushup.com\/blog\/30-tech-and-social-bloggers-you-need-to-follow\/\">social networking <\/a>activities, receive online advertisements, play network-connected games, and interact with any online content. <\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>More examples include smart speakers, VOIP services, voice assistants, and Internet-enabled-location-based services.&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>*COPPA\u2019s scope of applicability is limited to US-based audiences. It applies to websites and online services that collect data from children in the US, irrespective of where they\u2019re operating from.&nbsp;<\/p>\n\n\n\n<h2 id=\"h-what-is-personal-information\"><span class=\"ez-toc-section\" id=\"What_is_personal_information\"><\/span><strong>What is personal information?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to the federal trade commission\u2019s guidelines, personal information include:<br><\/p>\n\n\n\n<ul><li>First and last name of website users&nbsp;<\/li><li>Online contact and residential information&nbsp;<\/li><li>User\u2019s social security number&nbsp;<\/li><li>A username that functions as online contact information&nbsp;<\/li><li>A photograph, audio file, or vide where such file contains the child\u2019s images or voice&nbsp;<\/li><li>A telephone number&nbsp;<\/li><li>Any persistent identifier that can be used to identify the user across online or offline services&nbsp;<\/li><\/ul>\n\n\n\n<h2 id=\"h-parental-consent-under-coppa\"><span class=\"ez-toc-section\" id=\"Parental_Consent_Under_COPPA\"><\/span><strong>Parental Consent Under COPPA<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 312.5 of FTC\u2019s COPPA guidelines deals with parental consent. Any website or online service shall obtain parental content before gathering, storing, processing, or disclosing any personal information belonging to a child. <\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>The act recommends all child-directed operators to also verify parental consent through technology-based solutions. Hence, if an ad-tech company obtains data from under-13 users by offering child-directed services, then they must abide by COPPA.&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>The act also applies to third parties in the digital advertising ecosystem. These steps include:<\/p> <ol class=\"schema-how-to-steps\"><li class=\"schema-how-to-step\" id=\"how-to-step-1636371998817\"><strong class=\"schema-how-to-step-name\">Check if your online service of website is collecting personal information from users below the age of 13:<\/strong> <p class=\"schema-how-to-step-text\">Publishers or ad tech companies can use different age verification techniques to identify the ages of their users. If their audience base is 13+, they don\u2019t need to worry about COPPA compliance.\u00a0<br\/><br\/>i. COPPA only applies to websites that:<br\/>ii. Serve content or ads to under 13 users and collect their data<br\/>iii. Do not have age-restriction filter for a new sign up\u00a0<br\/>iv. Have an external plugin that collects information specifically from the children\u00a0<\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1636372013771\"><strong class=\"schema-how-to-step-name\">Ensure your website has a visible privacy policy that abides by COPPA requirements:<\/strong> <p class=\"schema-how-to-step-text\">If your content or ads cater to kids under the age to 13, your website should have all the information about the personal data that\u2019s being collected from online users. For example:<br\/><br\/>i. Manner of data collection\u00a0<br\/>ii. Type of personal data that you store\u00a0<br\/>iii. Information about third parties or sources that are processes user\u2019s personal data\u00a0<br\/>iv. The policy must have a clearly visible section on parent\u2019s rights on their children\u2019s personal data.<\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1636372031014\"><strong class=\"schema-how-to-step-name\">Take parental consent before asking for any personal information:<\/strong> <p class=\"schema-how-to-step-text\">Before gathering personal data from children, operators or publishers must give a clear notice to parents and request for their consent. They should be informed about:<br\/><br\/>i. Why the website is seeking their child\u2019s personal information\u00a0<br\/>ii. How their consent is linked to the company\u2019s privacy <a href=\"https:\/\/www.adpushup.com\/blog\/adsense-policy-guide\/\">policy<\/a>\u00a0<br\/>iii. What information has been collected and where they\u2019ll be used\u00a0<br\/>iv. Whether you\u2019ll be disclosing the information to <a href=\"https:\/\/www.adpushup.com\/blog\/google-delays-the-phasing-out-of-third-party-cookies-until-2023\/\">third party <\/a>sources\u00a0<br\/><br\/>This notice should also mention ways through which parents can give their consent. COPPA also asks online operators to delete user information if parents do not give consent in a reasonable amount of time.<\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1636372073639\"><strong class=\"schema-how-to-step-name\">Make sure to verify that parent\u2019s consent that you\u2019ve received:<\/strong> <p class=\"schema-how-to-step-text\">COPPA also asks the operators to verify parental consent that they\u2019ve taken. The FTC website doesn\u2019t mention any specific method for obtaining verifiable parental consent. But here are few acceptable methods:<br\/><br\/>i. Parents can sign an online consent form and send it back to the operator or company through email or postal service\u00a0<br\/>ii. A toll free number can be made available for parents to give their consent to trained professionals\u00a0<br\/>iii. Parents can provide any government ID\u00a0<br\/>iv. Websites can use facial recognition technology to verify consent\u00a0<\/p> <\/li><li class=\"schema-how-to-step\" id=\"how-to-step-1636372096414\"><strong class=\"schema-how-to-step-name\">Ensure clear communication between parents and the website\u00a0<\/strong> <p class=\"schema-how-to-step-text\">FTC suggests the website operators to frequently inform parents about new updates in its privacy policy.
